Information notice on the protection of personal data

Preamble

Agency :an “Agency” is a client in the real estate sector who has subscribed to one of Apiwork SA’s solutions or through its network of resellers.
User : u“User” is an employee or a self-employed person of an Agency that has subscribed to one of Apiwork SA’s solutions or through its network of resellers.
Subcontractor : Apiwork SA refers to the “Subcontractor” as the technical service provider who manages the storage of the User’s and Agency’s data.
Subscription Contract : the “Subscription Contract” defines the services subscribed by the Agency with the Subcontractor.

The Subcontractor attaches particular importance to the protection of your personal data (or “personal data”).
The purpose of this Notice is to set out, in accordance with Article 28 of the GDPR, the conditions under which the Processor processes Personal Data on the instruction of the User in the context of the services defined in the Subscription Agreement.

For the purposes of this section, the Customer is presumed to be acting as a Data Controller. If the Customer is acting as a Subcontractor on behalf of a third party Data Controller, the Parties expressly agree that the following conditions apply:

As a data controller, we are responsible for the collection and processing of the User’s personal data in the course of our activities.
The purpose of this Notice is to inform the User about what personal data we collect about them, why we use and share it, how long we keep it, what your rights are and how you can exercise them.
Where appropriate, additional information may be provided to you when the User subscribes to a particular product or service from our partners.

1. Scope of Personal Data

We collect and use personal data, i.e. any information that identifies the connected person, to the extent necessary for our activities, and thus to provide you with access to the data in the context of our mission as a Subcontractor (see paragraph 2).

Depending in particular on your level of access and the service we provide to you, we collect different types of personal data, including :

• • User identification information (e.g. full name, date of birth, telephone number, photo, job title, text presenting your background, trade register number, etc.) (see paragraph 2);
• • information of the User’s private or professional clients/prospects (e.g. surname, first name, company name, postal address, e-mail address, telephone number, marital status, nationality, search criteria, identity document, contracts related to your activity ...) (see paragraph 3) ;

We never ask you to provide other sensitive data such as data relating to your racial or ethnic origin, your political opinions, your religious or philosophical beliefs or relating to your trade union membership, genetic data or data relating to your life or sexual orientation, unless we are obliged to do so by law.
The User is also requested not to misuse the fields of the various forms to add this type of information.

2. Collection of personal data

We collect data directly from the Users of the Agencies, or from the Agency manager (when your manager creates an account for you, when you contact us or use our services).

You can access this personal data from your “My Account” area after logging in. Also you can update this information which will be necessary to authenticate you from the application or during the support process.

Depending on the needs of your activities, certain information is transmitted to partners, in particular to third party real estate portals and applications to which we communicate your contact details (telephone, e-mail and trade register number) as well as your name, first name and real estate agency.

3. Personal data related to your activity

Our services allow you to enter confidential data of third parties (your customers and prospects), please inform the person to whom this data relates that we are processing his or her personal data and refer them to this notice.

4. Personal data linked to that of our partners

Our services allow Users to collect confidential data from third party applications (e.g. Google, Microsoft Office 365 ...). This data is collected only after your consent and according to the perimeter that you define..
This personal data is used to synchronise your diaries, classify your e-mails about your customers and prospects, send an e-mail from your e-mail server, etc.
